Welcome to the PetMuse Studio's Privacy Policy

This privacy policy (the “Policy”) sets out the basis which PetmuseStudio, Inc. [*SLB to Client: We note that in the Terms of Service, the name of the company is “PetMuse Studio Inc.” (collectively, “PETMUSESTUDIO”, “we”, “our” or “us”) collects, uses, discloses and/or otherwise processes the Personal Data (as defined below) that you have provided to us through your use of our Platforms (as defined below), including any data you may provide through this website when you purchase a product from us, whether now or in the futureThis Policy applies to all Personal Data (as defined below) in our possession or under our control, including Personal Data (as defined below) in the possession of organizations which we have engaged to collect, use, disclose or process Personal Data (as defined below) for our purposes, and applies to all PETMUSESTUDIO websites that link to this Policy, including www.PetmuseStudio.com and any other PETMUSESTUDIO websites (collectively, the “Sites”), and any PETMUSESTUDIO mobile applications (the “Apps”, and collectively with the Sites, the “Platforms”, and collectively with the services we provide as described on our Platforms, the “Services”) that are owned and/or operated by or on behalf of PETMUSESTUDIO.

By using the Services, registering for an account with us, accessing the Platforms, making a purchase from PETMUSESTUDIO, or otherwise communicating or interacting with PETMUSESTUDIO, you acknowledge and agree that you accept the practices, requirements and/or policies outlined in this Policy, and you agree and consent to PETMUSESTUDIO, as well as our respective representatives and/or agents collecting, using, disclosing and processing your Personal Data (as defined below), and disclosing such Personal Data (as defined below) to PETMUSESTUDIO’s authorized service providers and relevant third parties in the manner set forth in this Policy. If you do not agree to the terms of this Policy, please discontinue using our Services or accessing our Platforms immediately.

1. Personal Data

In this Policy, “Personal Data” refers to any data, whether true or not, about an individual who can be identified (a) from that data, or (b) from that data and other information to which we have or are likely to have access, including data in our records as may be updated from time to time. Depending on the nature of your interaction with us, some examples of Personal Data which we may collect from you include, without limitation, your personal particulars, such as your name, contact number, residential address, email address or telephone number. It does not include data where the identity has been removed (i.e., anonymous data).

2. Collection of Personal Data

2.1  The Personal Data that PETMUSESTUDIO may collect (depending on the nature of your interaction with us) include but not limited to the following:

  • your personal details, such as your first name, last name, username or similar identifier, title, date of birth, gender and marital status;

  • your contact information, such as mobile or home telephone number(s), residential or mailing address, and/or email address;

  • your payment information, such as card issuer and card type, credit or debit card number, expiration date, CVV code, and/or billing address;

  • your photographs, videos, audio recordings and/or other biometric information, such as your photos, pictures, audio recordings you upload to our Platforms, and/or recordings of phone calls you make to our phone numbers;

  • your preference information, such as your account settings (including any default preferences), any preferences you have indicated, the types of services/offers that interest you, the areas of the Platforms that you have visited and/or ways that you interact with our Platforms;

  • your personalization and engagement data, such as your journey online and how you use our Service and/or Platforms, whether and when you open our marketing emails and push notifications and respond to our advertisements, what you clicked through on our Platforms, and/or what you purchased;

  • your browser information, such as when you use the Platforms, some data is automatically transferred from your browser to our server, including your browser type, operating system type or mobile device model, viewed web pages, links that are clicked, IP address, mobile device identifier or other unique identifier, sites or apps visited before coming to the Platforms, the amount of time you spend viewing or using the Platforms, etc.; and/or

  • any other information relating to any individuals which you have provided us in any forms you may have submitted to us, or via other forms of interaction with you.
  • We generally rely on Personal Data provided by you. In order to ensure that your Personal Data is current, complete and accurate, please update us if there are changes to your Personal Data by informing our data protection officer (the “Data Protection Officer”) in writing or via email at the contact details provided below. We reserve the right at our sole discretion to require further documentation to verify the information provided by you. Failure on your part to do so may result in our inability to provide you with the products and services you have requested.

    2.2  If you sign up to be a user of our Platform using your social media account (the “Social Media Account”), link your PETMUSESTUDIO account to your Social Media Account or use any PETMUSESTUDIO social media features, we may access information about you which you have voluntarily provided to your Social Media Account provider in accordance with such provider's policies, and we will manage and use any such Personal Data in accordance with this Policy at all times.

    2.3  If you provide us with any Personal Data relating to a third party (e.g., information of your spouse, children, parents, and/or employees), by submitting such information to us, you represent and warrant to us that you have obtained the consent of the third party to provide us with their Personal Data for the respective purposes.

    2.4  PETMUSESTUDIO may collect Personal Data from you directly or indirectly and/or from any third parties through one or more of the following ways:

    • when you register and/or use our Services or Platforms, or open an account with us;

    • when you submit any forms, including, without limitation, application or registration forms, or other forms relating to any of our products and services;

    • when you enter into any agreement or provide other documentation or information in respect of your interactions with us, or when you use our Platforms;

    • when you interact with us (including when you interact with our customer service agents), such as via telephone calls (which may be recorded), letters, fax, social media platforms and/or emails;

    • when you use our Platforms or interact with us via any of our Platforms, including, without limitation, through cookies which we may deploy when you interact with us via any of our Platforms;

    • when you request that we contact you or request that you be included in an email or other mailing list;

    • when you respond to our promotions, initiatives or to any request for additional Personal Data;

    • when you are contacted by, and respond to, our marketing representatives and customer service officers;

    • when you fill up surveys administered by our third-party surveying service providers;

    • when you link your PETMUSESTUDIO account with your social media or other external account or use other social media features, in accordance with the provider’s policies;

    • when you carry out transactions through our Services;

    • when you provide us with feedback or complaints;

    • when we seek information from third parties about you in connection with the products and services you have applied for; and/or

    • when you submit your Personal Data to us for any other reason.

      2.5  The above does not purport to be exhaustive and sets out some common instances of when Personal Data about you may be collected.

      3. Purposes for the Collection, Use and Disclosure of Personal Data

      3.1  The Personal Data from you may be collected, used, disclosed and/or processed for various purposes, depending on the circumstances for which we deem fit to process your Personal Data. By using our Services and/or Platforms, you agree that and consent to our collection or use of your Personal Data for the purpose(s) notified to you at the point of such collection or use, and for any or all of the following purposes include but not limited to:

    • to validate, confirm, verify, deliver, install, and track your order, including to arrange for shipping, handle returns and refunds, maintain a record of the purchases you make, to service products you purchased from us, and to provide you offers that may be of interest to you;

    • to communicate with you via phone, email and text, to send you, newsletters, information, promotional materials and other offerings that may be of interest to you, to offer a sweepstakes, contest or other promotion, when you contact us, when you request customer service or support, to complete your subscription on the Platforms, and to administer your account with us;

    • to provide you with customized products, services, and offers that may be of interest to you, including add-on individual products (e.g., pet toys) and to personalize our communication with you;

    • to administer your customer account;

    • to check that the right person is using the right card or account, meets the requirements of the card brands or account issuers, and to make sure we are paid for what you buy;

    • to measure customer satisfaction and improve our products and services;

    • to deliver to or communicate with the person at the address which you have requested;

    • to enhance your online shopping experience, including as a way to recognize you and welcome you to the Platforms, to provide you with customized Platform content, targeted offers from others, promotions and advertising on the Platforms, through other third-party sites or apps, via email, text messages, or App push notifications that are offered by us or others that might be of interest to you;

    • to handle your requests, to contact you when necessary or requested, including responding to your questions and comments and providing customer support, and to obtain customer feedback and improve our customer service and customer shopping experience;

    • to know you better, to make our communications with you more personal, to learn and improve from your survey feedback, and to understand overall customer sentiment and trends;

    • to use in marketing, including through reports in our social media accounts;

    • to improve our Platforms, products and services, customer service, and customer shopping experience;

    • to make sure the Platform technology works properly with your device, to make sure you can see and use our intended website and apps on the device you are using, for analytical and demographic purposes;

    • to protect the security and integrity of the Platforms and our business, such as by protecting against and preventing fraud, unauthorized transactions, and managing risk exposure, including by identifying potential hackers and other unauthorized users;

    • to protect customers, the public and our business against risks and crime, to prevent loss, to prosecute crime, and to defend ourselves; and/or

    • any other purposes which we notify you of at the time of obtaining your consent.
    • 3.2  PETMUSESTUDIO may also collect, use and share non-personal or aggregated information which does not personally identify you or any other visitor or user of the Platforms. We may use aggregated personal information such as statistical or demographic information for any purpose, including for statistical analysis and research. Aggregated Data could be derived from your Personal Data but is not considered Personal Data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data which will be used in accordance with this Policy.

      3.3  In addition to the purposes listed in Sections 3.1 and 3.2 above, PETMUSESTUDIO may collect, use and disclose your Personal Data for the following purposes:

    • to comply with applicable legal and regulatory requests and obligations (including investigations);

    • to establish or defend legal claims and allegations;

    • for security or the prevention, detection, or investigation of fraud, suspected or actual illegal activity, violations of company policy or rules, or other misconduct;

    • to seek advice and consultation from lawyers, auditors, insurance companies, and other professional advisers;

    • with potential or actual purchasers of all or part of our business in connection with a business transaction; and/or

    • any other purpose reasonably related to the aforesaid.
    • 3.4  In relation to particular products and services or in your interactions with PETMUSESTUDIO, we may also have specifically notified you of other purposes for which we collect, use or disclose your Personal Data. If so, we will collect, use and disclose your Personal Data for these additional purposes as well, unless we have specifically notified you otherwise.

      3.5  As the purposes for which we will/may collect, use, disclose or process your Personal Data depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of the applicable data without your consent is permitted by the privacy laws.

      3.6  The purposes listed in the above sections may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

      4. Disclosure of Personal Data

      PETMUSESTUDIO will take reasonable steps to protect your Personal Data against unauthorized disclosure. Subject to the provisions of any applicable law, your Personal Data may be disclosed by PETMUSESTUDIO, for the purposes listed above (where applicable), to the following entities or parties:

    • companies providing services relating to insurance, marketing and consultancy to PETMUSESTUDIO;

    • agents, contractors or third-party service providers who provide operational services to PETMUSESTUDIO, such as courier services, telecommunications, information technology, payment, printing, billing, payroll, processing, technical services, training, market research, call centre, security, employee recognition or other services to PETMUSESTUDIO

    • any business partner, investor, assignee or transferee (actual or prospective) to facilitate business asset transactions (which may extend to any merger, acquisition or asset sale) involving PETMUSESTUDIO;

    • external banks, credit card companies and their respective service providers;

    • our professional advisers such as consultants, auditors and lawyers;

    • relevant government ministries, regulators, statutory boards or authorities or law enforcement agencies to comply with any laws, rules, guidelines and regulations or schemes imposed by any governmental authority; and/or

    • any other party whom you authorize us to disclose your Personal Data to.
    • 5. Use of Cookies and Web Beacons

      5.1  Cookies are small pieces of information which are issued to your computer when you visit a website and which store and sometimes track information about your use of the site.

      5.2  We or our authorized service providers and advertising partners may from time to time use cookies or other features to allow us or third parties to collect and/or share information in connection with your use of our Services or Platforms. These features help us improve our Platforms and the Services we offer, help us offer new services and features, and/or enable us and our advertising partners to serve more relevant content to you, including through remarketing.

      5.3  We may use cookies to:

    • allow you to use the Platforms without having to re-enter your username;

    • enhance or personalize your Platforms usage and shopping experience;

    • monitor Platform usage;

    • manage the Platforms; and/or

    • improve the Platforms and our products and services, including providing you with interest-based ads.
    • 5.4  Should you wish to disable the cookies, you can set your browser to reject cookies or you can manually delete individual cookies or all of the cookies on your computer by following your browser’s help file directions. However, if your browser is set to reject cookies or you manually delete cookies, you may have some trouble accessing and using some of the pages and features that are currently on the Platforms, or that we may put on the Platforms in the future. Note that browser-management tools for cookies are outside of our control and we cannot guarantee their effectiveness.

      5.5  We may also use web beacons on the Platforms, in our emails, and in our advertisements on other websites. Web beacons are tiny graphic images that are used to collect information about your visit to the Platforms, such as the pages you view and the features you use, as well as information about whether you open and/or act upon one of our emails or advertisements. We may also collect the URL of the website you visited immediately before coming to the Platforms. Web beacons help us analyze the Platform visitors’ behavior and measure the effectiveness of the Platforms and our advertising. We may work with service providers that help us track, collect and analyze this information.

      5.6  We may combine the information we collect through cookies and web beacons with other information we have collected from you or information from other sources.

      6. Internet-based Advertising

      6.1  We may allow the third-party advertising companies such as those provided by Google and Facebook that use tracking technologies to serve our advertisements across the Internet. These advertising companies may collect information about your visits to the Platforms and other websites and your interaction with our advertising and other communications. These advertising companies serve ads on behalf of us and others on non-affiliated sites, and some of those ads may be personalized, meaning that they are intended to be relevant to you based on information collected about your visits to the Platforms and elsewhere over time. Other companies may also use such technology to advertise on the Platforms.

      6.2  You have the choice to tell us not to collect and use this information, and in some jurisdictions, we will only engage in interest-based advertising if you opt-in.       7. Protection of Personal Data

      7.1  PETMUSESTUDIO uses commercially reasonable physical, technical, and administrative security measures to protect your Personal Data in our possession or under our control to prevent unauthorized access, collection, use, disclosure and/or alteration or similar risks. However, we cannot guarantee the security of your Personal Data which we may have collected from or about you, or that for example no harmful code will enter our websites, applications, and digital services (for example viruses, bugs, trojan horses, spyware or adware). You should be aware of the risks associated with using websites, applications, and digital services, and no security measures are perfect or impenetrable.

      7.2  While we strive to protect your Personal Data, we cannot ensure the security of the information you transmit to us via the Internet, when you use our Platforms and the method of electronic storage. We urge you to take every precaution to protect your Personal Data when you are on the Internet and when you use our Platforms. We recommend that you change your passwords regularly and ensure that you use a secure browser.

      7.3  If applicable, you undertake to keep your username and password secure and confidential and shall not disclose or permit it to be disclosed to any unauthorized person, and to inform us as soon as reasonably practicable if you know or suspect that someone else knows your username and password or believe the confidentiality of your username and password has been lost, stolen or compromised in any way or that actual or possible unauthorized transactions have taken place. We are not liable for any damages resulting from any security breaches, on unauthorized and/or fraudulent use of your username and password.

      8. Minors' Data

      The Platforms and the Services are not directed to minors under the age of 18 or equivalent minimum age depending on jurisdiction, and PETMUSESTUDIO does not knowingly collect personal or other information from a minor it knows is under the age of 18 or equivalent minimum age depending on jurisdiction. If we become aware that we have inadvertently received Personal Data from a minor under the age of 18 years or equivalent minimum age depending on jurisdiction, we will delete such information from our records.

      9. Links to Third-Party Websites

      9.1  The Platforms may contain links to third-party websites, such as social media sites like Facebook, Instagram or Twitter, which are not controlled by us. We do not accept responsibility or liability for the privacy practices, data collected or the content of such other websites. Accordingly, if there are terms and conditions, privacy statements or policies appearing on such other websites, we recommend that you should also review them carefully before disclosing any personal information as your use of those websites may be subject to them. Please contact those websites and/or platforms directly if you have any questions about their privacy policies.

      9.2  You may choose to create accounts on websites or platforms owned or controlled by third parties to purchase our products. These third parties may use your information for their own purposes, including for behavioral advertising and analytics purposes. We do not control and are not responsible for the collection, use or other processing of your information by these third parties through the accounts you create with them. Please refer to their privacy policies to learn about how they handle your Personal Data.

      9.3  We shall also not be deemed to endorse, recommend or guarantee any information, tool, service or product that may be provided on such third-party websites. As such, we disclaim liability for any loss, damage, and any other consequence resulting directly or indirectly from or relating to your access to any third-party website, or any error, omission, or misrepresentation on any third-party website.

      10. Your Rights in relation to your Personal Data

      10.1  You may have the right under applicable data protection laws to ask:

    • for details of the Personal Data we hold about you;

    • information about the ways in which your Personal Data may have been used or disclosed during the past year;

    • for a copy of your Personal Data;

    • that we correct your Personal Data where it is inaccurate and/or that we complete your information where it is incomplete;

    • that we limit or restrict your Personal Data in certain cases; and/or

    • that we delete your Personal Data in certain cases.
    • 10.2  Please note that you will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. If so, we will inform you of the fee before processing your request. Alternatively, we could refuse to comply with your request in these circumstances.

      10.3  You may also withdraw any consent you give to us at any time and request us to stop using and/or disclosing your Personal Data for any or all of the purposes listed above by submitting your request in writing or via email to our Data Protection Officer at the contact details provided below. Whilst we respect your decision to withdraw your consent, please note that depending on the nature and scope of your request, we may not be in a position to continue providing our goods or services to you and we shall, in such circumstances, notify you before completing the processing of your request. Please note that withdrawing consent does not affect our right to continue to collect, use and disclose Personal Data where such collection, use and disclosure without consent is permitted or required under applicable laws.

      10.4  Please note that we may need to request specific information from you to help us verify or confirm your identity in order to process a request made to exercise your rights in relation to your Personal Data. This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

      10.5  If you make a request to delete your Personal Data, please note that we may not delete all of your information. We may still process your Personal Data if it is necessary to do so and we are lawfully permitted. For example, in the following circumstances:

    • to complete a transaction for which the Personal Data was collected, provide goods or services requested by you, or perform a contract we have with you;

    • in the context of detecting and/or preventing security incidents and/or to debug or repair any errors; and/or

    • to protect against fraud or illegal activity or to comply with applicable laws or resolve legal claims or exercise rights under applicable laws.
    • 10.6  Upon receipt of your written request in relation to the above, we may require reasonable time (depending on the complexity of the request and its impact on our relationship with you) for your request to be processed and for us to notify you of the consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us. In general, we try to respond to all legitimate requests within thirty (30) days. Occasionally it could take us longer than thirty (30) days if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

      11. Do Not Track

      Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, PETMUSESTUDIO and the Platforms do not recognize DNT.

      12. Retention of Personal Data

      12.1  We may retain your Personal Data for as long as it is necessary to fulfil the purpose for which it was collected, or as required or permitted by applicable laws.

      12.2  We will cease to retain your Personal Data, or remove the means by which the Personal Data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purpose for which the Personal Data was collected, and is no longer necessary for any business or legal purposes in accordance with the privacy laws and/or other applicable laws.

      12.3  We endeavour to adopt reasonable measures to dispose of the Personal Data within a reasonable time after it is no longer necessary. For instance, paper documents containing Personal Data are securely destroyed, and electronic files storing Personal Data are permanently deleted.

      13. Transfer of Personal Data to Other Countries

This Policy applies in conjunction with any other notices, contractual clauses and consent clauses that apply in relation to the collection, use and disclosure of your Personal Data by us.

      16.2  We may from time to time update this Policy without any prior notice to ensure that this Policy is consistent with any changes in legal or regulatory requirements and/or our future developments. All updates to this Policy will be published on our Platforms, you may determine if any such revision has taken place by referring to the date on which this Policy was last updated. If we make any material changes to this policy, we will provide you with an appropriate notice as required by law. Any such material changes will only apply to Personal Data collected after the revised Policy takes effect. Your continued use of our Platforms and/or Services constitutes your acknowledgement and acceptance of such changes.
